The Fourth Circuit unanimously affirmed the district court’s decision that 18 U.S.C. 4248 of the Adam Walsh Act is unconstitutional. The federal government does not have the authority to enact U.S.C. 4248 which concerns the civil commitment of sex offenders following their incarceration.
